New Secretary General Explains IOI's Relocation to Vienna

Vienna sees itself as a place of international encounter and therefore received considerable support from the national government and city of Vienna, which both consider that the move will strengthen Vienna’s status as a seat of international organisations. I believe that this also confirms the worldwide recognition of the role of the ombudsman as an old-established institution.
The new Secretary General also said he will be developing a website to provide information to all member institutions, from the legal basis to practical considerations, and organizing regional training programs. (Wein International.)

Western Michigan University Ombuds Reflects on Her First Year
The campus newspaper for WMU interviewed Kathy Mitchel, who has been the Ombuds since July 2008. She earned her BA and MA degrees from Western Michigan and has worked on the campus ever since. She describes how her perspective changed in the job:

When I first started, I thought, “I am going to have all these people come to me with their problems and I can’t do anything, this is going to be frustrating.” I don’t tell people what to do. I don’t go to the professor and tell them “you have to change this grade, or you need to do this, how frustrating.” But as it turns out, not being the person who makes the decision at the end of the day is actually really empowering because it frees me up to be able to help work the system for students, faculty, and staff.

Profile of Alvin Ailey Dance Foundation Ombuds
The latest alumni magazine for Sarah Lawrence College features a profile of Rona Carr, the Organizational Ombuds for the Alvin Ailey Dance Foundation. Regarding her work, she said:
Carr is also the founder and principal of Austin International Group, a human resources, business communications and project management consulting company. (Sarah Lawrence Magazine.)
I don’t dance at all, but I’ve always wanted to work with a performing arts organization—they have interesting human resources challenges. You have to work with the person as a whole person, because for performers, how they feel when they get up in the morning affects how they do their jobs. In business there are much stricter parameters for what topics you talk about. In the performing arts, people are romantic together, they scream at each other, and the relationships are a lot more open.

Report by Ombuds Becomes Critical Evidence in Lawsuit Against University

According to the court's summary, the case arose when faculty from the business USM business school complained about Depree's allegedly negative and disruptive behavior, and failure to engage in scholarly or professional activities. The University President relieved Depree of his teaching obligations and barred him from the campus. (Depree retained his title, tenure and salary despite USM's actions.) The President also requested the Provost to have the Ombuds investigate the charges against Depree. The Ombuds produced a report containing what the court characterized as "wholly dispassionate conclusions and recommendations." It was this report that gave the court a reason for the appellate court to remand the case for further development. The court said, "the late intervention of the Ombudsman report and [the President’s] response to it have created a factual moving target." The USM Ombuds is not identified by name in the court decision, nor is there a USM webpage for the Ombuds. (Depree v. Saunders, 2009 U.S. App. LEXIS 24969 (5th Cir. Miss. Organizational Ombuds, especially those in higher education will be quick to point out that they never conduct investigations at the behest of administrators and never issue written recommendations regarding the resolution of specific cases. Unfortunately, for Ombuds practicing in Mississippi, Louisiana and Texas, the case law now indicates otherwise.

Canadian and European Higher Ed Ombuds Will Convene in Vienna


The theme, "Common objectives, different pathways: Embedding Ombudsman principles and practices into Higher Education institutions," emphasizes ways of resolving disputes fairly by comparing different experiences of higher education Ombuds in a wide variety of settings. The first day of the conference will feature workshops and training session. The final two days of the conference will provide plenary presentations followed by concurrent sessions and reports back to the plenary. More details should be by mid-December 2009. House Bill Would Create External Ombuds for SEC
Earlier this month, the House Financial Services Committee approved H. 3817, which would reform the Securities and Exchange Commission and strengthen its powers to protect investors and to regulate the securities markets. A late amendment by Kevin McCarthy (R-CA22) to the bill would create an Ombuds position reporting directly to the SEC Chairperson. The proposed SEC Ombuds would serve as a confidential liaison and be able to make policy recommendations. Rep. McCarthy sponsored a similar bill in the last legislative session that was unsuccessful. University of Memphis Provost Overrules Faculty, Keeps Ombuds

The effect on the UM Ombuds is an open issue. Although Ombuds are adept at dealing with conflicts, they generally do not like to be directly involved. In this case, the situation could lead some to believe that the Ombuds cannot be neutral with respect to the Provost. On the other hand, the Ombuds may now enjoy a sense of job security and independence that could allow him to be more outspoken when necessary. As with most Ombuds, the critical issue is his reputation prior to this incident.

Cheesecake Factory Agrees to Ombuds Program in Settlement with EEOC

Many EEOC discrimination cases have been settled with the defendant company agreeing to implement an Ombuds program. In most cases, the details are sparse and later it is impossible to locate any public information regarding the promised Ombuds program. (See, e.g., Nike Settles Discrimination Lawsuit, Agrees to Ombuds; Minneapolis Restaurant Settles EEOC Lawsuit, Agrees to Hire Ombuds; Trucking Firm Settles Discrimination Lawsuit and Agrees to Hire Ombuds.) The rare exception was Coca Cola's settlement of an EEOC case in 2000 that resulted in a prominent Ombuds office.

Law Society Equity Ombuds Assist Canadian Legal Professional
Many Canadian law societies, which regulate the profession in the public interest, have added an Ombuds service to assist lawyers, law students and legal support staff who want help resolving complaints of discrimination or harassment. According to Canadian Lawyer Magazine, law society Equity Ombuds are usually an outside contractor, not a law society employee, hired as part of a broad program to promote diversity and equity in the legal sector. Equity Ombuds are similar to Organizational Ombuds in that they both provide confidential, neutral and informal services. Some even provide anonymous feedback to law firms and offer training services.

Senate Bill Would Create Private Student Loan Ombuds Program
Senator Sherrod Brown (D-OH) has introduced a bill to create a private education loan Ombuds office to assist students in conflicts with their private lenders. The proposed Ombuds office would provide private loan borrowers with the same services offered by the Federal Student Aid Ombudsman. Unlike FSOA, which is part of the the Department of Education, the proposed private education loan Ombuds would report to the Secretary of Treasury. The bill, S. 2733, has been referred to the Senate Committee on Health, Education, Labor, and Pensions. (GovTrack, S. 2733 status; via NAFSAA News.)

Update: Jury Returns Verdict for University of Washington in Rape Case

The implications for Organizational Ombuds in Washington State as a result of this case are significant. There is now legal precedent in Washington State for concluding that reporting discrimination to an Ombuds is sufficient to put a university on notice. There is now case law that permits the Washington courts to take evidence regarding mediation communications with a university Ombuds. Washington courts now have legal authority to find that a university may be liable for how an Ombuds handles a matter. In the future, Organizational Ombuds in Washington will have to convince the courts that their practice differs enough to avoid the reasoning of S.S. v. Alexander. Although there is some basis for such an argument (the UW Ombuds did not follow many of the standards of practice for Organizational Ombuds), it will be more difficult for Organizational Ombuds in the Evergreen State.

Update: Jury Deliberating University of Washington Rape Case

One other crucial piece of evidence got both sides arguing to the jury—a handwritten letter, signed by the plaintiff in October, 2001, saying, "With this I consider the issue I brought to the Ombudsman's office thoroughly taken care of… and closed."

Portland State University Ombuds Ready for Peak Season
Sandy McDermott serves as the only Ombuds for the 24,000-student public university in Oregon. Since she serves the entire PSU community, McDermott is often the first to notice trends among the individuals who come to her for aid. A recent concern is an increasing number of students who self-identify as homeless. As she approaches the end of the calendar year, "peak season," McDermott is unable to accept walk-ins due to the high volume of cases. (PSU Daily Vanguard.)
Top 100 Influential Hispanics Includes Former Texas A&M Faculty Ombuds
Hispanic Business magazine has named Antonio Cepeda-Benito, former faculty Ombuds at Texas A&M University, to the publication’s 2009/2010 list of the nation’s 100 “most influential” Hispanics. Cepeda-Benito served as the Ombuds from 2006 until 2009, when he was promoted to dean of faculties and associate provost. (Hispanic Business; TAMU News.)

Both Health Care Reform Bills Would Create Ombuds Program
Progressive blogger Jon Walker observes that both versions of the House and Senate health care reform legislation would create a new health care Ombudsman program to help people deal with insurance companies. In the Senate Finance Committee bill, people would only be allowed to seek help from the Ombuds if their internal appeals last more than three months, or they were facing a life-threatening situation.
