Ombuds of Texas to Look at Emergence of the Profession at August Meeting

The Ombuds of Texas will meet August 11 and the topic will be "Evolution of the Ombuds." The bi-meeting will be held at the LCRA Dalchau Service Center in Austin.

Noted Journalist Serves as First Ombuds for EMPA

In January 2010, the Swiss Federal Laboratories for Materials Testing and Research (commonly known as Empa, German for "Eidgenössische Materialprüfungs- und Forschungsanstalt") appointed Michael Hagmann as its first Ombudsperson for PhD students.

Empa is a Swiss research institution for applied materials sciences and technology that supports about 160 PhD students. Hagmann earned his masters at the Laboratory for Experimental Immunology and PhD at the Institute for Molecular Biology of the University of Zurich and then did post-doctoral research at UC Santa Cruz. He then became a science journalist and worked for Discover magazine, the journal Science, and SonntagsZeitung. Hagmann has serves as the Communications Director for Empa since 2005.

As the Ombuds, Haggman’s primary task is to resolve serious conflicts between doctoral students and their supervisors at Empa and/or to mediate between the parties involved. According to the Empa Ombuds webpage, "The work carried out by the ombudsman’s office is strictly confidential, independent and neutral. It is not bound by directives and is not accountable to the Empa directorate." (Empa Ombudsperson, Communication, Hagmann Interview.)

IOA to Offer Ombuds Training in Toronto

The International Ombudsman Association will offer introductory and advanced training for Organizational Ombuds at the Hyatt Regency Toronto, October 25-29, 2010.


Programs to be offered are:
  • Ombudsman 101 (October 25-27) -- A 2½-day introductory training program that covers the basic functions and skills of Ombudsmanry using an interactive format includes role play and encourages questions and discussion.
  • Ombudsman 101 Plus (October 27) -- A half-day course on how to communicate the value and benefits of an Ombuds function internally to management who are considering starting an Ombudsman Office, and from the outside by an entrepreneur.
  • Master Class (October 28-29) -- A two-day course for experienced Ombuds based on the master class in the music world. The first day will be dedicated to observing and discussing the styles of seasoned practitioners and the second day will give each participant the opportunity to practice different techniques and to explore and analyze the individual and systemic elements at play in the cases.
Course instructors have not been announced. Priority registration closes September 24. (IOA Professional Development.)

New CERN Ombuds Debuts Website

A website for the Ombuds at the European Organization for Nuclear Research went online yesterday and provides more information about the program that was introduced last month. The page reveals that the Ombuds--Vincent Vuillemin--serves full time for a three year term. The website also references the International Ombudsman Association Code of Ethics and Standards of Practice.

The new site posts the CERN Ombuds Mandate, which is effectively the charter for the office. Materials also include Vuillemin's first presentation about the office and a video of the public meeting when he was introduced to the CERN staff. (CERN Ombuds.)

Public Invited to Comment on Proposed SEC Ombuds Office

The Securities and Exchange Commission is calling for public commentary on proposed regulatory initiatives under the Dodd-Frank Act, including the new Ombuds for the Office of the Investor Advocate. Members of the public can express their view by email or an online form.

The new SEC Ombuds will be named by the head of the Office of the Investor Advocate, who is appointed by the SEC Chair. The Investor Advocate will be responsible for assisting individual investors confidentially with issues involving the SEC or other self-regulatory organization. 

Since the Dodd-Frank Act did not specify any guidelines for implementing the new Ombuds program, the SEC will rely in part on public commentary in setting up the program. The public comment period will remain open for 30 days, following publication of the comment request in the Federal Register. (SEC Press Release; Public Comment Form.)

Auburn University Appoints Ombuds to Permanent Post

Auburn Provost Mary Ellen Mazey and the Executive Committee of the University Senate has reappointed Jim Wohl to a three-year term. Wohl recently completed a two-year trial as the university's first Ombuds for employees.

"The trial period was focused on establishing the office," Wohl said. "I'm eager to focus this next phase on building rapport and ensuring that employees all across campus know about the Ombuds Office and how it can be of assistance." He will continue to spend three-quarters of his time as Ombuds while he teaches in the veterinary curriculum and a mediation course. Wohl presented a session on preventative Ombudsing at the IOA conference last April.  (Wire Eagle.)

Tenth ACR Conference Will Highlight Ombuds Issues

The Association for Conflict Resolution's tenth annual conference will include several sessions that Organizational Ombuds will find relevant, including:




  • Building a Conflict Competent Organization Phase II: What Practitioners, Organizations, and the Conflict Resolution Profession Can Learn and Apply in the Workplace (Session 4.13) -- How ConEdison built organizational conflict competence and provided conflict management services with input from the Ombudsman, HR, EEO, Labor Relations, Ethics, Security and Training.
  • Sharing "Trade Secrets": Tips and Techniques from Cross-Section Colleagues for Expanding Your Practice (Session 5.15) -- A panel including Nick Diehl and Calio Azcarte will use the World Café process to explore key practices and tools used by practitioners in one area that might be adapted to enhance the effectiveness of others and how to grow the demand for constructive workplace conflict resolution practices via collaboration across practice areas.
  • Transparency In Action: Surfacing and Resolving Conflicts - The Kaiser Permanente Health Care Ombudsman/Mediator Program (Session 6.12) -- Kaiser Ombuds will present an overview of the HCOM model including a historical perspective, the specific model, conflict resolution strategies, as well as types of cases and key learnings.
  • Managing Your Energy in Mediation: How the Conflict Resolution Practitioner Can Thrive (Session 7.09) -- This interactive, skill building and practice enhancing workshop will highlight critical component of self care helping practitioners manage the personal energy required to perform their work based on the Kaiser Permanente Health Care Ombudsman/Mediator Program.
The ACR conference takes place at the Hyatt Regency Chicago, September 1-4, 2010. Priority registration ends August 2. It does not appear that there will be an Ombuds Section meeting as in years past. (ACR 2010 Conf. Info.)

University of Miami Ombuds Offers Guidance for Students in Conflict

Last week, the student newspaper at the University of Miami published an interview with Dr. Gail Cole-Avent, who serves as the Ombudsperson for non-academic issues. She explained that Miami relies on a network of "University Troubleshooters" to triage student concerns and refer more significant issues to the Ombuds office.

Cole-Avent offers students in conflict five pointers:
  1. When in doubt, seek us out. Our motto is probably one of the most effective ways to find a resolution. S.T.O.P and Come See Us First. If you think you have a question or anticipate something may need to be addressed, see us first. The University Troubleshooters and Ombudsperson representatives want to help students talk out possibilities for resolving their concerns.
  2. Start early. Many students wait until that last moment, which can be a challenge if a quick response is needed. Start seeking out the appropriate people early. Even if you have a preliminary question, the troubleshooters and appropriate ombudsperson can point you in the right direction.
  3. Learn about the Policies and Procedures. If applicable, ask about the policy and procedure that addresses your concern. It will describe the parameters and if there are any exceptions. Fully read and understand any contract that you sign. A contract at UM is the same as a contract with any other institution or business. You must fulfill your commitment.
  4. Document your interactions. Keep a record of who you spoke to, when you spoke to him/her, and the outcome. This is good practice for life. When speaking to students, we hear the general statement “they told me.” It is challenging to address the specifics of a scenario with the elusive “they.”
  5. Be Respectful. Yelling, screaming or cursing a fellow student or administrator is not the most effective way to resolve a situation. Some situations will lead to frustration, but try to keep a cool demeanor. Individuals are more willing to listen and respond when they are engaged in a conversation where respect is exhibited.

Financial Regulatory Reform Will Create New Ombuds Programs

The sweeping reform legislation signed into law by President Obama on July 21 will establish an Ombuds programs for the Securities and Exchange Commission concerns and two programs within the new Consumer Financial Protection Bureau. An early version of the legislation also included an Ombuds program for the Public Company Accounting Oversight Board, but this was not included in the final version.

The new SEC Ombuds will be named by the head of the Office of the Investor Advocate, who is appointed by the SEC Chair. The Investor Advocate will be responsible for assisting individual investors with issues involving the SEC or other self-regulatory organization such as the New York Stock Exchange. The new Ombuds would serve as a confidential liaison for the same population. The bill does not provide any guidelines for implementing the Ombuds program, so details need to be worked out. The bill does state, however, that the new Ombuds office will not replace or diminish any existing agency Ombuds.

The reform bill also establishes two Ombuds programs in the Consumer Financial Protection Bureau. The first serves as the Agency Ombuds for the Bureau -- essentially a confidential liaison for individuals with problems relating to the activities of the Bureau, resulting from the regulatory activities of the Bureau. The details of this new Ombuds program are undefined.

In addition, there will be a separate Ombuds program to mediate disputes between student borrowers and private lenders. Here again, there are few details, but it is expected that the new Ombuds will resemble the existing Ombuds at the Department of Education which serves students with federal student loan issues. It is clear that the new Ombuds programs to be enacted need to be further defined. How and when this will happen remains to be seen. Unfortunately, there is no indication that any Ombuds of any type or any Ombuds professional associations are even participating in the process. On the positive side, the Coalition of Federal Ombudsmen has been an important resource for new Ombuds programs in the federal sector in the past. Hopefully they will fill the need.

FCO President to Speak at Brazilian Ombuds Conference

Ian Darling, President of the Forum of Canadian Ombudsman, will be a featured speaker at the 1st International Congress of Executive, Legislative, Prosecutorial and Judicial Ombudsmen in Belo Horizonte, Brazil.

Darling will participate in two panels, one of the role of Ombuds in Canada and the United States, and the other on the development Classical Ombuds in North America. The event convenes public and private sector Ombuds, politicians and academics from the Americas and Europe and incorporates the 13th Brazilian Congress of Ombudsmen. Job Posting: Jackson Community College

The 6,700-student community college in Jackson County, Michigan is hiring an Ombuds. The full-time position provides students a "consistent, centralized point of contact for questions, concerns and/or problems they may be experiencing at JCC." It appears that this is the first Ombuds for the college.

Reasons Agreements Fall Apart After Workplace Negotiations

Mediator and conflict resolution coach Dr. Tammy Lenski writes Conflict Zen, one of the blogs I read faithfully. In her latest post, she considers why do solutions and agreements fall apart after the organizational conflict appears resolved.

Lenski sees eight reasons agreements fall apart after workplace negotiations seem to have resolved the conflict:
  • It wasn’t really agreement.
  • Agreement-building was hurried.
  • They felt pressured by someone in higher authority.
  • The agreement failed to solve the real problem.
  • It didn’t really meet their most important interests.
  • The not-really-agreed-upon solution didn’t come from those directly involved in the conflict but it sure sounded good at the time.
  • There were stakeholders missing.
  • Something changed.

Recap of 2010 Midwest Meeting of University & College Ombuds

Tim Griffin reports that 24 Ombuds from 18 different colleges and universities convened on the campus of Northern Illinois University in DeKalb, Illinois on July 12. The annual meeting was preceded by a workshop for 13 new Ombuds -- a new attendance record for this event.

Topics for plenary discussion, established by those in attendance, included bullying, mobbing, confidentiality of third party information, neutrality, appropriate advocacy, responding to institutional leadership transitions, the professionalization of the profession, working with large groups and departments, employee evaluations, roles in non-traditional mediation, talking with parents, attending formal meetings and hearings as an observer, relationships with general counsel, and more. In addition, breakout sessions were offered on deciding whether or not to mediate, technology and confidentiality, the role of the Ombuds during an organizational crisis, and essential interviewing skills. 

Griffin extended special thanks to volunteers who presented breakout sessions or lead case discussions: Judy Bruner, Dave Carver, Kerry Egdorf, Kathie Gilbert, Jean Griffin, Craig Mousin, and Sue Theiss. The meeting next year, which will once again be open to all, is tentatively scheduled for July 11, 2011.

African Development Bank Ombuds Increases Capacity

AfDB Ombuds Amabel Orraca-Ndiaye has issued an annual report to Bank staff outlining key areas of the office’s main activities last year. The report emphasizes that the Ombuds office will continue to play to create increased group cohesion in the institution.

According to a press release from AfDB, 2009 was a successful year for the Ombuds office, given the institution’s current context of growth in diversity. The Ombuds office handled 100 cases Bank-wide and the program continued to evolve by consolidating and building on established initiatives and activities. Ndiaye commended Bank staff who have understood the need to come over to her office to share views with her collaborators. “When staff take the pain to visit us, it is a sign of confidence in the informal recourse system and that has really helped us to prevent a number of conflicts,” she said. The AfDB Ombuds office was created in 1992 and Ndiaye was appointed in late 2009. (AfDB News.)

ICANN Ombuds Receives Peacekeeping Medal

According to his blog, Frank Fowlie has been awarded the Canadian Peacekeeping Service Medal for his service in East Timor with the United Nations Transitional Administration.

The CSPM recognizes Canadian peacekeepers deployed internationally for at least 30 days. Fowlie joins about 74,000 other Canadians who have received the honor since 1988. (ICANN Ombuds Blog.)

Job Posting: Federal Bureau of Investigation

The FBI is conducting an internal search for a Supervisory Ombudsman to be stationed in Washington, DC. This appears to be a re-posted position that was open to external candidates earlier in the year.

The Supervisory Ombudsman serves as the Chief Ombuds and consultant to the Director and FBI executives, and directs the FBI's informal conflict resolution program. The position is open only to current FBI employees and the individual selected will be required to serve a one-year supervisory probationary period. The GS-15 position pays $123,758-$155,500 and applications are due July 22. (Federal Government Jobs.)

African Educator Calls for University Ombuds

In the wake of student riots at several prominent universities in Kenya, Nigeria and South Africa, a leading educator is recommending that campuses adopt Ombuds programs.

Goolam Mohamedbhai, the former Secretary-General of the Association of African Universities, the former President of the International Association of Universities and the former Vice-Chancellor of the University of Mauritius, says there are many reasons for the unrest after years of neglect and under-funding. He offers several solutions and called in particular for "Campus Ombudsmen" to listen to student grievances and avert major crises. Mohamedbhai cited the positive effect of Ombuds programs at American universities and the UK Office of the Independent Adjudicator.

In response to the article, Boubakar Barry (Coordinator of the Research and Education Networking Unit at the Association of African Universities) pointed out that there are several African universities with Ombuds programs, including Cheikh Anta Diop University in Dakar, Senegal which has had an Ombudsman for about seven years. Growing Business for Workplace Chaplains

Last night, the NBC Nightly News profiled a service more employers are adopting to care for their employees: office chaplains.  "Finding someone to listen – really listen – to your personal concerns is not what most offices are known for but some folks are trying to change that, with chaplains at work." (NBC Nightly News.)

The largest supplier of the service is Marketplace Chaplains, USA, a nonprofit headquartered outside Dallas. According to their website, the service is "voluntary, confidential, neutral from company operating structure, [and] available to ALL employees." The operating principles are based on the U.S. military chaplain program. Marketplace Chaplains currently serves nearly half a millions individuals at 418 companies. The company has recently started expanding its multi-denominational service to companies in Canada, Europe, Puerto Rico and Mexico. (Marketplace Chaplains.)

LSU Ombuds Office Faces Elimination Under 2011-12 Budget

Louisiana State University has outlined $46 million in possible budget reductions for the 2011-12 fiscal year in anticipation of severe cuts to higher education. A committee divided campus units into three categories and the Ombuds Office is in the first category targeted for cutbacks.

The proposal would eliminate the halftime Ombuds position that was established in 2006. Kirsten Schwehm is the LSU Ombuds and helped organized the most recent IOA conference in New Orleans. (LSU Plan Announcement and Level 1 Cuts; WAFB News.)

New Research Confirms Cost of Workplace Conflict and Reveals Benefit of Venting

Research by economists at the University of Nottingham has revealed that feuding opponents will continue to retaliation even when they realize their efforts are damaging their own interests.  Fortunately, the likelihood of vendettas is mitigated by giving participants the opportunity to vent their anger.


The study looked at the development of vendettas in games where participants were allowed to ‘steal’ a proportion of the others’ probability of winning. Researchers found that protagonists often pursued the conflict well beyond the reasonable limits of self-interest: 70% of the games showed ‘tit for tat’ stealing which resulted in both party’s chances of winning reducing below 10%, thus ending the game. The study thus confirmed earlier research that workplace conflict is often economically irrational.

More relevant to the work of Organizational Ombuds was the additional observation that the number of mutually destructive games fell when players could vent their feelings between rounds. Researchers found that the more open subjects were in venting their negative emotions state, the less aggressive they were in pursuing vendettas. “This research has obvious potential applications for attempts to reduce the level of conflict in settings such as the workplace,” said co-author Dr Jonathan Tan, of Nottingham University Business School.
We found venting provides an opportunity for people to channel their feelings, which is an alternative to engaging in destructive behaviour. Providing non-destructive ways for workers to channel such emotions could therefore be used to cut aggression in the workplace.

University of Missouri–Kansas City Appoints First Faculty Ombuds

UMKC has named long-time professor Nancy Day as its first Ombuds for faculty matters. The announcement seems to indicate that Day will be available to all faculty rather than just faculty from the School of Arts & Sciences as initially contemplated.  She begins a two-year term on September 1, 2010.

Day joined UMKC in 1991 and is currently a tenured associate professor in human resources and organizational behavior. She earned her PhD in social psychology with an emphasis in organizational psychology from the University of Kansas, and a master’s degree in counseling psychology from UMKC. In addition to her teaching duties at UMKC, Day has serves in a variety administrative positions including a stint as director of the Executive MBA program and interim associate dean of the business school, the Bloch School. Her research focuses primarily on compensation and diversity. Day has been active in several professional associations, including WorldatWork, the Midwest Academy of Management, and the Society for Industrial and Organizational Psychology.  (UMatters.)

Job Posting: University of Michigan

The Public Ivy in Ann Arbor is hiring an Ombudsperson. The full-time position serves student body of 41,000 and reports to the Vice President for Student Affairs. Applicants must have a Master's degree or better, experience in student services administration or counseling, and knowledge of University practices.

Although the description is poorly written and the position does not report to a top administrator, the office has historically followed best practices for Organizational Ombuds. The search will fill the position vacated by the retirement of Robert Holmes and currently held on an interim basis by Tom Lehker. Ombuds for Department of Defense Inspector General Posts First Annual Report

Scott M. Deyo, who became the first DoD IG Ombudsman on March 1, 2009, met with 225 employees in the first seven months on the job -- nearly 14% of the 1,600 DoD IG employees worldwide. Most of the contact resulted from a climate assessment survey, which gave Deyo the opportunity to interview individuals about organizational concerns and to introduce the new Ombuds program.

Deyo reports that employees shared concerns shared related to the DoD IG mission, organization, strategic matters, policies, practices, and procedures. The top three major categories of issues dealt with supervisory relationships, mission, and colleague relationships, respectively. In addition to a detailed analysis of employee concerns, Deyo also provides a history of federal dispute resolution and the Ombuds field, and a copy of the DoD IG Ombuds charter. ABA 2011 Dispute Resolution Conference Set for Denver

The American Bar Association Section on Dispute Resolution convenes its 13th Annual Spring Conference at the Sheraton in downtown Denver on April 13-16, 2011. For the first time in several years, the largest Ombuds conference and the largest ADR conference will not conflict.

The IOM Office of the Director General in Geneva is hiring an Ombuds for a one-year appointment. The position follows IOA Standards of Practice and Code of Ethics and assists staff members with employment-related problems.

Applicants should have a university degree in a related field and ten years of experience for mediation and conflict resolution in an international oriented organization. Fluency in speaking English and French or Spanish is required. California Caucus Returns After Year Hiatus

After missing its first year in nearly four decades, the California Caucus of Colleges and University Ombuds returns to Asilomar in Pacific Grove, California, November 7-12, 2010. The conference has been a fixture for West Coast Ombuds since 1973, but did not occur in 2009 due to declining attendance. Organizers and stakeholders have spent the past year strategizing about return of the event, which is uniquely different than other Ombuds conferences.

This year, workshops, presentations, case studies, and panels of Ombuds will focus on the theme of “The Ecology of Ombudsing – Building Sustainable Value." Confirmed workshop presenters include Lisa Neale and Mary Chavez Rudolph (University of Colorado, Denver), Martine Conway (University of Victoria) and Kerry Egdorf (Marquette University). Job Posting: Cleveland Clinic, Florida

The Cleveland Clinic has reopened its search for an Ombudsman Manager to be stationed in Weston, Florida. In addition to resolving patient problems, the position will provide ongoing training and support to Ombuds staff and represent the Ombudsman Department throughout the state and nationally.

USCIS Ombuds Submits Annual Report to Congress

The Office of the Citizenship and Immigration Services Ombudsman has submitted its seventh annual report to Congress. The Ombuds for Department of Homeland Security immigration issues provides confidential, independent and impartial assistance to the public.

The report highlights systemic problems at USCIS arising out of declining revenues, modernization efforts, adjudication requests and customer service inquiries. The USCIS Ombuds also made 20 recommendations for administrative changes. (USCIS Ombuds 2010 Report.)

Update: UN Ombuds Reports Growing Demand for Service

At a press briefing this afternoon, United Nations Assistant Secretary-General and Ombudsman John Barkat joined other administrators to report on the organization's new justice system. Barkat said his office has opened 536 cases in the first five months of 2010, a 70% increase from the same period last year.

He interest in the Ombuds service is growing because it is quick, interest based, preserves relationships and allows parties to select the outcome themselves. The UN internal justice system handles disputes between staff and management, which cannot be filed in national courts. (UN News Centre.)

BP Targeting Its Internal Ombuds Program

CNN is reporting exclusively that BP has been trying to shut down its Ombudsman program. According to "sources close to the office" and Rep. Bart Stupak, the Ombuds office headed by retired federal judge Stanley Sporkin has been targeted for closure. (CNN.)
Meanwhile, Truthout is reporting that Sporkin gave Congress misleading or false information in response to an investigation about North Slope safety concerns.  (Truthout.)

I am somewhat skeptical that the BP Ombuds is in imminent danger. When the chairman of a congressional subcommittee investigating your company has your number on speed dial, it would unwise to fire the Ombudsman you hired up under pressure from lawmakers. BP should be motivated to keep Sporkin close and reduce any incentive for him to become a witness at the next round of congressional hearings.

IOA to Offer Organizational Ombuds Training in Paris

UNESCO will host the next training offered by the International Ombudsman Association September 6-8 in Paris.  Two courses will be presented: one for beginning Ombuds and one specialized course. 

Ombudsman 101 will be offered September 6-7, 2010. This course covers the fundamentals of the organizational Ombudsman role; it will benefit the recently-appointed Ombudsman, individuals interested in becoming an Ombudsman, or anyone desiring to establish an Ombudsman function in industry, government, higher education, and public or private social services agencies. The instructors will be Danielle Fischer-Lebailly, European Ombudsman for Mars Inc., and Georgia Shaver, Ombudsman for the UN World Food Programme.

Mediation and the Ombudsman, a specialized course, will be offered September 8. This all-day program will introduce practicing Ombuds to mediation, the mediation process, and mediation programs. Instructors will examine the relationship between Ombuds practice and mediation, two of the most common informal dispute resolution mechanisms used to resolve workplace conflict. The course will be taught by Camilo Azcarate, Manager of Mediation Services for the World Bank, Doris Campos-Infantino, Ombudsperson for the Inter-American Development Bank, Donna Douglas Williams, Ombudsman for the World Health Organization, and Linda Toyo Obayashi, Mediation Officer for the World Bank.
